A pedestrian tripped and fell on a municipal sidewalk and was injured. She sued the City The City investigated and measured and photographed the sidewalk ledge with a proper measuring device and determined it was not a hazard. The plaintiff had used a loonie to measure the trip ledge and her photographs were taken at a higher angle making it difficult to prove whether it was a hazard or not. City also had an annual inspection protocol in place. The court ruled in favour of the City and dismissed the action.
